This application for regular bail arises out of Kargahar P.S. Case No. 145 of 2016, disclosing offences punishable under Sections 406, 407, 408 and 420/34 of the Indian Penal Code. The petitioner is in custody since 29.07.2017. There is a Writer Safeguard Private L.T.D. Company, which audits the ATM's of various Banks. The persons named in the F.I.R. were the employees of the said private company. It transpires that in one of the audits conducted in 2016, huge shortage of cash to the tune of Rs.34,76,400/- was noticed. Allegedly, the petitioner who had the responsibility to deposit cash in the ATM's, is said to have misappropriated the said amount with the help of other accused persons.

Patna High Court CR. MISC. No.78104 of 2019(3) dt.06-03-2020 2/2 Mr. Rajeev Kumar Verma, learned counsel appearing on behalf of the petitioner has submitted that the same occurrence has given rise to three criminal cases, namely, Kargahar P.S. Case No. 90 of 2016, Kargahar P.S. Case No. 91 of 2016, and the present one. He has drawn my attention to an order of this Court dated 08.09.2016 passed in Criminal Miscellaneous No. 30615, whereby the petitioner has been allowed regular bail.

The Court presumes that the charge sheet, to the extent the same relates to the petitioner, must have been submitted by now.

Considering the facts and circumstances, particularly the period of custody of the petitioner since 29.07.2017, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2, Rohtas, Sasaram in connection with Kargahar P.S.
