2. The petitioner seek bail in connection with Kutumba P.S. Case No. 253 of 2023 instituted for the offences punishable under Sections 30(a), 32(i)(ii) and 41(i) of Bihar Prohibition and Excise (Amendment) Act.

3. As per the prosecution case, total 7992 liters of illicit foreign liquor was recovered from the truck.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. They have no concern with the alleged recovered liquor and truck. Nothing incriminating article has been recovered from their conscious

Patna High Court CR. MISC. No.80829 of 2024(2) dt.07-02-2025 2/2 possession. It is further submitted that co-accused has already granted bail in Cr. Misc. No. 80829 of 2024. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. They are languishing in judicial custody since 16.08.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise-1st, Aurangabad in connection with Kutumba P.S. Case No. 253 of 2023.
