Mr.Syed Mojibur Rahman ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-11-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Town P.S.Case No. 847 of 2019, registered for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act. The allegation is regarding the police having raided the house of the co-accused person, namely, Rahul Kumar and upon a search being made, one country made pistol along with one live cartridge was recovered whereafter other co-accused persons, namely, Mahesh Paswan and Ashok Kumar Singh were also apprehended and arms / cartridges were recovered from them. The petitioner herein is stated to be the father of the said Rahul Kumar.

The learned counsel for the petitioner has

No.68969 of 2019(2) dt.27-11-2019 2/2 submitted that no recovery has been made from the petitioner and merely on account of the fact that he is the father of the co-accused person, namely, Rahul Kumar, he has been made an accused in the present case with ill motive. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 20.9.2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Town P.S. Case No. 847 of 2019.
