The petitioners apprehend their arrest in Srinagar (Pujaha) P.S. Case No. 20/2018, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 504 of the Indian Penal Code.
Chowkidar Ramchandra Yadav is the informant of the case. It is alleged that during course of inspection the informant got smell of country-made wine. While the informant was searching the wine in straw, petitioners and other villagers are alleged to have made protest and also entered into scuffle with the informant.
Patna High Court Cr.Misc. No.39665 of 2018 (2) dt.10-07-2018 2/2 Learned counsel for the petitioners submits that no occurrence, as alleged by the informant has ever taken place. The informant wanted to implicate the petitioners in a false case. The villagers made protest and for that the informant lodged this case. Considering the facts aforesaid and nature of allegation made against the petitioners, they are, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Bettiah, West Champaran in connection with Srinagar (Pujaha) P.S. Case No. 20/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
