JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 This is an application for grant of anticipatory bail in connection with Koilwar P. S. Case No. 201 of 2019 disclosing offences under Section 379 of IPC and Section 4(40) of the Bihar Mineral Concession Rule, 1972 and Section 3 of Bihar Minerals Prevention of Illegal Mining Transportation and Storage Rules, 2003 and Section 15 of Environment Protection Act.

As per prosecution case, on information the Assistant Director of Mining raided the Sone River and found 20-30 tractors engaged in illegal mining of the sand and it is said that the petitioners are the owner and drivers of the said tractors. Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case only on

Patna High Court CR. MISC. No.73593 of 2019(3) dt.10-01-2020 2/2 suspicion. They have no criminal antecedent. They are ready to abide by any condition imposed on them.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Bhojpur, Ara, in connection with Koilwar P. S. Case No. 201 of 2019.
