The petitioner seeks modification of the order dated 09.07.2019 passed by a Bench of this Court in Criminal Appeal (SJ) No. 1835 of 2019. By the aforesaid order, the petitioner was directed to be enlarged on bail in the event of his arrest or surrender before the Court below within a period of four weeks from the date of passing of the order.

However for the reasons which have been explained in the petition, the petitioner could not surrender

Patna High Court CR. MISC. No.74926 of 2019(2) dt.01-07-2020 2/2 within the period mentioned in the order dated 09.07.2019. The order dated 09.07.2019 is modified to the extent that in case the petitioner surrenders before the court below within a period of six weeks from today, he shall be accorded the privilege under the order dated 09.07.2019 with the same terms and conditions.

The order stands modified to the extent indicated above.

The modification application stands disposed of accordingly.
