====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 341, 342, 376 and 354/34 of the Indian Penal Code.
3. As per the prosecution case, while the informant was returning to her home, petitioner and co-accused Manoj Kumar forcibly pulled her inside a room, by putting dupatta in her neck, locked the room and committed rape upon her.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. Medical report does not support the prosecution case. Petitioner claims clean antecedent and he is in custody since 30.8.2024.
5. Learned counsel for the State opposes the prayer for bail. He submits that the petitioner is named in the FIR with specific allegation by the informant, aged about 17 years, that this petitioner and his accomplice forcibly locked her in the room and committed rape. He submits that the victim, in her
Patna High Court CR. MISC. No.79384 of 2024(3) dt.29-08-2025 2/2 statement recorded under section 164 of the Code of Criminal Procedure, has fully supported the prosecution case.
6. Considering the nature of accusation and victim's aforesaid statement, prayer for bail of the petitioner is rejected.
7. Since the petitioner is in custody since 30.8.2024, let the trial be expedited.
