The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per prosecution case, informant alleged that while he was going to C.S.P. in the meantime three unknown miscreants intercepted him and on the pistol point looted total cash of Rs. 6,34,000/- and other articles.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to local politics and on the confessional statement of the co-accused Suman Kumar

Patna High Court CR. MISC. No.1882 of 2023(2) dt.28-03-2023 2/2 before police, which has got no evidentiary value in the eye of law. It is further submitted that the petitioner is not named in the FIR nor he is put on TIP. Petitioner remanded in this case from another case i.e. Khajauli P.S. Case No. 113 of 2022. He is languishing in judicial custody since 20.07.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody of this petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khajauli P.S. Case No. 81 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhubani.
