JUSTICE ARUN KUMAR ORAL ORDER 29-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 17.4.2018, seeks bail in Palasi PS Case No. 37 of 2018 registered under Section 395 of the IPC.

Learned Counsel for the petitioner submits that the FIR is against unknown and only on the basis of information of the spy of the police he has been implicated in this case, neither any looted article has been recovered nor he was put on TIP, charge-sheet has been submitted in the present case without putting the petitioner on TIP and the petitioner has only one case against him lodged under Section 363 IPC.

Having considered the said facts and circumstances, the petitioner, namely, Tahzeeb @ Md. Tahzeeb is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VI Araria in connection with Palasi PS Case No. 37 of 2018.
