Petitioner apprehends arrest in a case registered for the offence punishable under sections 452, 341, 323, 324, 325, 326, 307, 379, 504, 506, 147, 148, 149 of the Indian Penal Code.
It is alleged that this petitioner along with other co-accused persons, assaulted the father and brother of the informant by means of butt and double barrel of gun, as a result of which 3 persons sustained injury. Thereafter, this petitioner is alleged to have snatched gold chain from informant and the accused persons fired from their guns to threaten to kill the whole family members.
Patna High Court CR. MISC. No.1605 of 2023(2) dt.08-05-2023 2/2 Learned counsel for the petitioner submits after panchayat election, a victory procession was going, in which maarpit took place. There is case and counter case, both sides sustained injuries. Petitioners claim clean antecedent.
Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned the Court of Learned Chief Judicial Magistrate, Jehanabad in connection with Ghoshi P.S. case No.492 of 2021 subject to the conditions laid down under section 438 (2) of the Code of Criminal Procedure.
