====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 11-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 28.5.2018, seeks bail in Chanan PS Case No. 147 of 2017 registered under Sections 302, 201 and 34 of the IPC.

The allegation in brief is that the informant's uncle was sleeping in the community building, he was found murdered and the informant raises suspicion that the petitioner and others have killed him because of some dispute.

Learned Counsel for the petitioner submits that there is no eye witness in this case, the petitioner is agnate of the informant and on account of dispute has falsely been implicated in this case, however later on realizing the fact the informant filed a protest petition in the court stating therein about false implication of the petitioner and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Kamaldhari Bind is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Lakhisarai in connection with Chanan PS Case No. 147 of 2017.
