JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This is an application for grant of anticipatory bail in connection with Majahidpur (Babarganj) P. S. Case No. 184 of 2019, disclosing offences under Sections 341, 323, 447, 427, 504, 34 of the Indian Penal Code and Section 25(1-B)a of the Arms Act.
As per F.I.R. petitioner has demanded Rs.1,30,000/- and on refusal, he fired on the informant but that does not hit the informant. Later on, the firm was snatched from the petitioner and handed over to the police by the informant. Submission of the learned counsel for the petitioner is that as a matter of fact, mother of the petitioner has sold a piece of land from the informant and for that Rs.1,30,000/- is due and moreover, the F.I.R. itself shows that fire arm does not hit anybody and this is not a case that police has recovered the arm,

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Bhagalpur, in connection with Majahidpur (Babarganj) P. S. Case No. 184 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
