JUSTICE ARUN KUMAR ORAL ORDER 04-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.2.2018, seeks bail in Bhabua (Sonhan) PS Case No. 131 of 2018 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.
The allegation in brief is that the informant was receiving threatening calls on his mobile and on the fateful day two persons appeared, opened fire which misfired and both of them were apprehended by the local people, produced before the police and country made loaded pistol and three live cartridges were recovered from them.
Learned Counsel for the petitioner submits that due to previous enmity the petitioner has falsely been implicated, the petitioner was not carrying any arms or fired, there is no injury to anyone and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Vishnu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kaimur at Bhabua in connection with Bhabua (Sonhan) PS Case No. 131 of 2018.
