The petitioner seeks regular bail in connection with 317/17 dated 9.12.2017 registered for offences punishable under Sections 304(B) and 201 of the Indian Penal Code. Allegation against the petitioner is of setting his wife on fire.
Submission of the learned counsel for the petitioner is that as a matter of fact while preparing food she caught fire. Petitioner has taken her at PMCH and later on she died. Petitioner is in custody for 01 year and 10 months and there is no chance of tampering with the evidence. Charge has already been framed.
Heard learned A.P.P. who has opposed the prayer for bail
Patna High Court CR. MISC. No.73349 of 2019(5) dt.05-02-2020 2/2 on the ground that during the investigation it has come that the petitioner used to assault the deceased in drunken condition.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge 2, Saran, Chapra in connection with S.Tr. No.430 of 2018 in connection with Dariyapur P.s.Case No.317 of 2017.
With the above direction, this application is allowed.
