JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kotwali (Barari) P.S. Case No.661 of 2016 for the offence under Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 05.06.2018. He further submits that in the instant case 169 litres of liquor was recovered. Learned counsel submits that nothing was recovered from the conscious possession of the petitioner. He submits that the seized vehicle was released in favour of the petitioner pursuant to the order of this Court vide order dated 17.05.2018 in C.W.J.C. No. 9055 of 2018.
