The petitioner claims that there are

Patna High Court CWJC No.3278 of 2023 dt.11-04-2023 2/2 many lawyers living in rented houses within 10 kms. radius of the High Court who require own residences which could be constructed on the allotted land.

The petitioner, but for submitting that the Society is registered under the Cooperative Societies Act, does not disclose the objects of the Society nor the nature of the membership in it. The petitioner also does not have any contention regarding the lawyers, for whom the writ petition is filed, being from the marginalized sections of the society who require special protection and care by the State. The allotment of lands for building Housing Societies for targeted group of people is a policy decision of the Government which cannot be precipitated by judicial orders.
