The petitioner seeks bail in Bounsi P.S. Case No. 97 of 2018 registered for the offence punishable under Sections 302, 307, 120B of the Indian Penal Code.

Informant in his written complaint has stated that on 11.04.2018 he alongwith other police personnel was on patrolling duty. At about 6:45 am after parking the patrolling vehicle at the road side they started keeping eye over the persons and vehicles passing through that road. Subsequently Haiwa vehicle bearing no. JH 04G 6417 rashly and negligently coming from other side dashed the patrolling vehicle in which one police personnel died. The said Hiwa vehicle was overloaded with sand.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.40467 of 2018(2) dt.13-07-2018 2/2 the petitioner is innocent and has committed no offence. Petitioner is the owner of the vehicle. It has been further submitted that the said vehicle was not having any illegal sand rather it was issued on a valid challan. Petitioner is in custody since 14.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka, in connection with Bounsi P.S.
