Petitioner apprehends his arrest in connection with Hathauri P. S. Case No.241 of 2018 registered for the offences punishable under Sections 147, 148, 149, 447, 323, 302 of the I.P.C.
Petitioner is named in the first information report. No doubt, no specific overt act has been attributed against the petitioner in first information report, but he happens to be member of unlawful assembly and in the present case, one person was killed and three persons sustained injury. Learned counsel appearing for the petitioner submits
Patna High Court CR. MISC. No.68453 of 2019(4) dt.22-06-2020 2/2 that having similar allegation, co-accused Bipin Ray has already been admitted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 06.08.2019 passed in Cr. Misc. No.48991 of 2019. It is true that co-accused has been admitted to anticipatory bail by a Coordinate Bench of this Court, but I am not in agreement with the findings given by the Coordinate Bench in Cr. Misc. No.48991 of 2019. Accordingly, this anticipatory bail petition stands rejected.
However, at the time of consideration of regular bail petition of the petitioner by a competent Court, this order shall not cause any prejudice to the concerned Court. (Hemant Kumar Srivastava, J) vikash/- U T
