JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-07-2018 The petitioner seeks bail in connection with Barun P.S. Case No. 97 of 2018 dated 17.05.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120(B) of the Indian Penal Code and Section 3/4 of the Prevention of Damage to Public Property Act, 1984.

The mob which had collected to protest against the death of a person in a road accident pelted stones at the Police Party and also caused damage to the public properties. Eighty six persons have been named in the F.I.R and several others though have not been named but have been shown as accused persons.

Patna High Court Cr.Misc. No.40441 of 2018 (2) dt.10-07-2018 2/2 There is no accusation against the petitioner even though he is named in the F.I.R.

The petitioner is in custody since 17.05.2018 and some of the accused persons of this case have been granted bail by different Benches of this Court.

The petitioner also does not bear any criminal antecedent.

Considering the aforestated facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 97 of 2018.
