The petitioner seeks bail in connection with Ariari (Mahuli) P.S. Case No. 152 of 2019 Excise Case No. 326 of 2019 for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from bush and the petitioner has no concern with the alleged recovery. The petitioner is rotting

Patna High Court CR. MISC. No.68633 of 2019(2) dt.06-11-2019 2/2 in judicial custody since 26.09.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Session Judge, Sheikhpura in connection Ariari (Mahuli) P.S. Case No. 152 of 2019/Excise Case No. 326 of 2019.
