1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the O.P. No. 2.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 504 and 498(A) of the Indian Penal Code read with Section 4 of the D.P. Act.
3. The learned counsel appearing on behalf of the O.P. No. 2, at the outset, submits that petitioner had come to the house of the O.P. No. 2 for fetching her back to her matrimonial home and the O.P. No. 2 has also accompanied him willingly. It is further submitted that he has instructions not to oppose the
Patna High Court CR. MISC. No.78697 of 2023(4) dt.05-09-2024 2/2 anticipatory bail application of the petitioner.
4. The Court expects that petitioner would keep the O.P. No. 2 with honour and dignity.
5. Considering the submissions made by the learned counsel appearing on behalf of the O.P. No. 2, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 88 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
6. Accordingly, the instant anticipatory bail application stands allowed.
