ANJANA MISHRA ORAL ORDER 16-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 06.06.2018 in connection with Kanti P.S. Case No.45 of 2013 registered for the offences punishable under Sections 20, 22 and 23 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that it appears that in Kanti P.S. Case No. 45 of 2013 dated 07.02.2013 registered under Sections 20, 22 and 23 of the NDPS, Act, the petitioner is set to have been named in the FIR and the seizure list is said to have been made near the house of the petitioner. In fact, the raiding party had recovered 11⁄2 Kg. Ganja like substance kept in the hay and wood in front of the house of the petitioner. It is

Patna High Court Cr.Misc. No.42467 of 2018 (2) dt.16-07-2018 2/2 further submitted that admittedly no recovery was made from the conscious possession of the petitioner and till date he was not aware regarding lodging of the present case. The petitioner is also having a clean antecedent.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge-cum-Sessions Judge, Muzaffarpur, in connection with Kanti P.S. Case No.45 of 2013.
