Petitioner apprehends arrest in connection with Excise Case No. 157 C 2 of 2012 registered for the offence punishable under sections 47(a)(F) of the Bihar Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. The place from where the recovery is alleged to have been made is a public place. Petitioner has no concern with the alleged recovered materials.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is

Patna High Court CR. MISC. No.68815 of 2019(2) dt.27-11-2019 2/2 named accused and during investigation materials have come showing complicity of this petitioner in the alleged crime.

Considering the facts and circumstances of the case, the nature of allegations levelled and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail this petitioner. His prayer for bail is, therefore, rejected.
