The petitioner seeks bail in connection with Kadamkuan P.S. Case No. 126 of 2018 dated 04.03.2018 instituted for the offence under Sections 356, 379 and 411 of the Indian Penal Code.

The petitioner is said to have been apprehended while running away after snatching the mobile telephone of the informant.

Learned counsel for the petitioner has submitted that there is a possibility of his having been nabbed by the people of the area on a mistaken identity. The petitioner is in custody since 05.03.2018 and at the time of his arrest by the local people, he was brutally assaulted.

Patna High Court Cr.Misc. No.39935 of 2018(2) dt.10-07-2018 2/2 Regard being had to the nature of accusation and the period of custody, the petitioner above named is directed to be released on bail on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-VII-cum-Additional Chief Judicial Magistrate, Patna in connection with Kadamkuan P.S. Case No. 126 of 2018, while saying so this Court also has taken note of the fact that the petitioner has a clean antecedent.
