The petitioner seeks bail in connection with Rupauli P.S. Case No.26 of 2018, registered under Section 302/201/34 of the I.P.C.
Allegation in brief is that the informant's wife saw petitioner and one co-accused smoking ganja in the nearby field where his wife was cutting grass. When informant returned back and enquired about his wife, the petitioner and one other escaped away and informant found his wife killed in the maize field. Learned counsel for the petitioner submits that only suspicious is raised against the petitioner. Informant is also not the eye witness and none has seen the occurrence and the investigation has already been completed in this case and
Patna High Court Cr.Misc. No.46586 of 2018 (2) dt.31-07-2018 2/2 accordingly charge-sheet is filed and it is further submitted that motive as alleged against accused persons is of committing rape but no such injury on her private parts except the cut mark on neck was found and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Md. Akhtar , is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, in connection with Rupauli P.S. Case No.26 of 2018.
