1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Noorsarai P.S. Case No. 565 of 2023 registered under Sections 420, 467, 468, 471, 120(B) of the I.P.C.

3. As per the first information report the petitioner obtained appointment as Panchayat Teacher on the basis of forged P.S.T.E. (Physical Training Certificate).

4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. Referring to Annexure-P/2 Series, learned counsel submits that the Office of the Director State Council of Educational Research and Training, Assam, Kahilpara, Guwahati by its letter dated 12th February, 2024 has confirmed that PSTE certificate issued

Patna High Court CR. MISC. No.81770 of 2024(2) dt.16-12-2024 2/2 by the institute has been found correct upon verification. The services of the petitioner has already been terminated by the District Programme Officer (Establishment), Nalanda vide letter dated 11.03.2024.

Regard being had to the submission made by the parties, taking into consideration the verification letter of the certificate of the petitioner at Annexure-P/2 dated 12th February, 2024 and the fact that petitioner has already been terminated, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-1st, Biharsharif, Nalanda in connection with Noorsarai P.S. Case No. 565 of 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anil Kumar Sinha, J) praful/- U T
