====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 341, 323, 307, 504, 506 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that on 11.05.2019 the plaster work was going in the house of the informant. During that, water fell towards the house of the petitioner. Upon which, he abused him. On objection, petitioner fired with pistol on him.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 26.06.2019. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.67936 of 2019(2) dt.24-10-2019 2/2 present case due to the village politics. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is alleged to have fired but the same did not hit anyone. None is said to have been injured in course of occurrence. No offence under Section 307 of the IPC is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist, Khagaria, in connection with Parbatta P.S. Case No. 149 of 2019, G.R. No. 1207 of 2019.
