JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 407 of 2018, arising out of Fulkaha P.S. Case No. 52 of 2018 for the offence under Sections 30(a), 36 & 38 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody in connection with seizure of 81 liters. Learned counsel submits that liquor was not recovered from the conscious possession of the petitioner. Petitioner is in custody since 24.03.2018. Considering the fact that the petitioner has remained in custody for more than three months and he has no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court Cr.Misc. No.40363 of 2018(2) dt.10-07-2018 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Araria, in connection with Fulkaha P.S. Case No. 52 of 2018.
