JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bariyarpur P.S. Case No. 99 of 2019, registered for the offences punishable under Sections 30 (a) of Bihar Prohibition and Excise Act 2016.

As per F.I.R. the police got information that petitioners and other accused-persons are engaged in the selling of liquor, raided the house of the petitioners and it appears that from the house of Siyaram Singh, brother of the petitioners there is recovery of 109.5 liters of liquor.

Submission of the learned counsel for the petitioners is that there is no recovery from the house of the petitioner rather from the house of one Siyaram singh and they are

Patna High Court CR. MISC. No.68896 of 2019(2) dt.18-11-2019 2/2 brothers of Siyaram Singh and as such they have been made accused in this case.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned Court and make prayer for regular bail which shall be considered on the basis of material available on record and shall be disposed of if possible on the same day.
