2. The petitioners apprehend their arrest in a case registered for the offences punishable under Section 137(2), 96, 3(5) of the Bharatiya Nayaya Sanhita, 2023.

3. As per the prosecution case, the informant alleged that the petitioners along with other co-accused persons have kidnapped her daughter.

4. Learned counsel for the petitioner submits that it would be apparent from the first information report itself that the informant has made an allegation against her own son-inlaw of having allured her minor daughter and kidnapped her. So far as the present petitioners are concerned, they happen to be the sister, bother and mother of the main co-accused, namely

Patna High Court CR. MISC. No.77668 of 2025(2) dt.27-11-2025 2/2 Nitish Kumar and only on account of such these petitioners have been made accused in the present case.

5. Learned APP for the State opposed the grant of bail on the basis of allegations made in the first information report.

6. Taking into consideration the facts and circumstances and considering that there is virtually no allegation of kidnapping against these petitioners, who only happen to be the relative of main co-accused, Nitish Kumar, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sahebpur Kamal P.S. Case No. 48 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
