The petitioner seeks bail in Bihta P.S. case No. 772 of 2019 registered under Section 147, 148, 341, 323, 324, 307, 379, 504, 506 of the IPC.

The petitioner and others are alleged to have assaulted Vikash Kumar and Chhotu @ Amarnath Kumar alleging them to be child lifters.

The learned counsel for the petitioner submits that the petitioner was apprehended on the spot but no specific allegation is made against him. Even during the course of investigation no injury report is brought on record. The petitioner is in jail since 09.08.2019.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that there is
