JUSTICE ARUN KUMAR ORAL ORDER 12-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.5.2018 seeks bail in Bihta PS Case No. 500 of 2018 registered under Sections 25(1-b)a and 26 of the Arms Act.

The allegation in brief is that one country made pistol with one live cartridge was recovered from the possession of the petitioner.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated at the behest of his co-villager, with whom he had enmity, the petitioner has no criminal antecedent and has been in custody for more than four months. Having considered the said facts and circumstances, the petitioner, namely, Sunil Kumar Singh is directed to be released on bail after framing of the charge in the case on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, Danapur Patna in connection with Bihta PS Case No. 500 of 2018.
