Petitioners apprehend arrest in a case registered for the offence punishable under sections 420,467,468,471/504 and other ancillary sections of the Indian Penal Code. As per the prosecution case, all the accused persons including these petitioners took away husband of the informant with themselves and got executed sale deed in favour of petitioner no.3. petitioner no. 1,2 and 4 are alleged to have
Patna High Court CR. MISC. No.997 of 2023(2) dt.08-05-2023 2/2 assisted petitioner no.3 in the execution of sale deed. Learned counsel appearing for the petitioners submits that the petitioner no.3 is the bona fide purchaser of the land who purchased the said land on payment of consideration money.
Learned counsel for the State as well as the informant oppose the prayer for bail. They submit that the accused persons took away mentally unsound husband of the informant and fraudulently got executed sale deed.
Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Samastipur in Sarairanjan Police Station Case No. 150 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
