JUSTICE SHIVAJI PANDEY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in connection with Kotwa P.S. Case No. 232 of 2017 registered for the offence punishable under Sections 363, 366 and 366 (A)/34 of the Indian Penal Code.

The allegation has been made by the informant that his minor daughter has been taken away by the petitioner for illegal purposes. When he contacted the parents of the petitioner, they started hurling abuses and later on, the girl has been recovered and she has made her statement against the petitioner, however, counsel for the petitioner submits that on the date of occurrence, the victim was major, which is very

He further submits that the victim and the petitioner have already entered the marriage under the Special Marriage Act and a certificate was issued by the Registrar of the Marriage. He also submits that the petitioner is in judicial custody since 25.07.2019.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down on account of pandemic Covid-19 to the satisfaction of Additional Chief Judicial Magistrate-10, Motihari, East Champaran in connection with Kotwa P.S. Case No. 232 of 2017.
