JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Complaint Case No. C-514 of 2018 giving rise to Tr. No. 2463 of 2019 for the offence under Section 498A of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Allegation against the petitioner is that he has tortured his wife for non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The marriage took place on 12.04.2015. With reference to para 12 of the petition, counsel submits that the petitioner is ready to keep his wife with full honour and dignity.

Considering the aforesaid, and in order to encourage restoration of normal conjugal life, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within one month from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sadar Motihari in connection with Complaint Case No. C-514 of 2018 giving rise to Tr. No. 2463 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In the event petitioner neglects, misbehaves or tortures the informant of this case, the Court below shall be at liberty to cancel his bail bonds.
