JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant. The petitioner, already in custody, seeks bail in connection with Manjhagarh P.S.Case No. 238 of 2015 registered under Sections 363 and 366A of the Indian penal Code.

Allegation in brief is that the petitioner also helped Murtaza Hafiz in enticing away the informant's daughter. Submission is that informant's daughter is major and it is a case of elopement as she has eloped with Murtaza Hafiz and the allegation of kidnapping in the day light is false and fabricated though there is no allegation levelled by the girl that she was physically or sexually exploited by the petitioner rather the same is specific against Murtaza Hafiz.

Patna High Court Cr.Misc. No.44952 of 2018(2) dt.27-07-2018 2/2 Whereas, learned counsel appearing on behalf of the informant opposed the prayer of the bail.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Shafi Ahmad @ Safi Ahmad is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Manjhagarh P.S. Case No. 238 of 2015.
