Petitioner is apprehending his arrest in connection with Ganga bridge P.S.Case No.143/18, registered for offences punishable under Sections 30(a), 38 and 47 of the Bihar Prohibition and Excise Act..
As per FIR there is recovery of the liquor from the other co-accused persons and from the house of one -accused Raja Rai a diary was recovered that shows involvement of the petitioner also and as such the petitioner has been made accused in this case.
Submission of the learned counsel for the petitioner is that he has been named in this case afetr one year and except the dairy, there is nothing against him.
Patna High Court CR. MISC. No.69456 of 2019(3) dt.19-11-2019 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below within a period of three months and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II cum Excise court, Vaishali at Hajipur in connection with Ganga Bridge P.S.Case No.143 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he has to appear before the police as and when required and co-operate in the investigation..
