JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 1436 of 2018, arising out of Fatuha P.S. Case No.86 of 2018, for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.02.2018 in connection with seizure of 50 litres of liquor. He further submits that co-accused have been granted regular bail as well as anticipatory bail by different Co-ordinate Benches of this Court.

Considering the fact that the petitioner is in custody since 16.02.2018 and also the fact that other co-accused have been granted regular bail as well as anticipatory bail, the petitioner, named above, is directed to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.40013 of 2018 (2) dt.10-07-2018 2/2 bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Patna in connection with Special Case No. 1436 of 2018, arising out of Fatuha P.S. Case No.86 of 2018.
