The petitioner is languishing in custody for the offences punishable under Sections 353/307 of the Indian Penal Code and Sections 25(1-b)a/26/27 of the Arms Act. On the disclosure of the petitioner pistol and cartridges were recovered from the house of the petitioner which were said to be used for the murder of Mr. Anjani Kumar Pandey.

In the past prayer for bail was refused considering the nature of allegation and criminal antecedent of the petitioner. The trial Court was directed to expedite the trial vide order dated 22.04.2019. The petitioner is in custody since 18.08.2017. The report of the trial judge reveals that the prosecution

Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.197 of 2018, arising out of Bihta P.S. Case No.566 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
