JUSTICE SHIVAJI PANDEY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in connection with Minapur P.S. Case No. 353 of 2019 registered for the offence punishable under Sections 341, 326, 307, 302, 120 (B) of the Indian Penal Code and Section 27 of the Arms Act.
The allegation has been made against the number of persons who were involved in the commission of the death of the victim. From the FIR, it appears that one Manoj Prasad, the then Sarpanch was arrested on account of being involved in the trading of illegal liquor and at the time of going to jail, he has directed his henchman to finish the victim, whereupon coaccused Sunil Kumar, Shushil Kumar and Shailendra Prasad
Patna High Court CR. MISC. No.69860 of 2019(4) dt.27-05-2020 2/2 killed the victim. The petitioner has series of litigations with the victim. The petitioner has criminal history but the case diary does not show that the petitioner was involved in the commission of murder of the victim.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down on account of pandemic Covid-19 to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 353 of 2019 with condition that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
