1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the Bank of India, Mr. Amresh Kumar.
2. The learned counsel appearing on behalf of the petitioner submits that some of the accused persons have been granted the privilege of anticipatory bail by this Court in the
Patna High Court CR. MISC. No.76056 of 2024(4) dt.07-02-2025 2/3 present case, as such seeking parity, it is submitted that petitioner be also granted the privilege of anticipatory bail, on which the learned counsel appearing on behalf of the Bank submits that the accused who were granted the privilege of anticipatory bail by this Court were given clearance by the vigilance wing of the bank whereas the case of the petitioner is pending consideration before the vigilance branch of the bank. It is also submitted by the learned counsel appearing on behalf of the Bank that he has instructions to make submission that the vigilance wing of the Bank will conclude the proceeding within three months from today.
3. At this stage, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the anticipatory bail application with liberty to move afresh in the event if the vigilance wing of the Bank exonerates the petitioner.
4. Permission is accorded.
5. Accordingly the instant anticipatory bail application is dismissed as withdrawn with the liberty aforesaid. CRIMINAL MISCELLANEOUS No. 79060 of 2024
