JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This application, for grant of anticipatory bail, arises out of Konch P.S. Case No. 18 of 2019, disclosing offences under Sections 420, 467, 468, 471, 196, 197, 198, 199, 201 and 120(B) of the Indian Penal Code.

Petitioner happens to be Panchayat Secretary of Simra and Kurmawan and allegation against him is that in spite of direction of the authorities, he has not submitted the file/folders relating to appointment of Niyojit teachers. Submission of learned counsel for the petitioner is that he has already handed over the charge and handed over the documents also and he has falsely been implicated in this case and ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Gaya, in connection with Konch P.S. Case No. 18 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that petitioner shall cooperate in investigation and appear before the Investigating Officer as and when required and also cooperate in departmental enquiry, if any, is going on.
