The petitioner is languishing in custody since 15.06.2019 in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
It is alleged that the informant's cash amount of Rs.42,708/-, articles worth Rs.36,000/- and a motorcycle were robbed off, leading to registration of the FIR against three unknown. During investigation, on the basis of confessional statement of the co-accused, the name of the petitioner sprang up.
It is submitted by learned counsel for the petitioner that neither any recovery has been made from the conscious physical possession of the petitioner nor the petitioner has been put on Test Identification Parade and the investigation
Patna High Court CR. MISC. No.69379 of 2019(2) dt.27-11-2019 2/2 has already been concluded. A statement has been made in paragraph no.3 of the petition that apart from the present case, the petitioner is accused in one other case in which he is on bail.
Learned APP for the State submits that the name of the petitioner sprang up during investigation. Considering the fact that the investigation has already been concluded and the petitioner has not been put on Test Identification Parade, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned I/C ACJM-II, Saran, Chhapra, in connection with Amnour P.S.
