JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 342, 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the on 20.09.2022 the informant had gone for natural call, all the accused persons caught him and started abusing. Accused persons also assaulted on vital parts of the body of the informant using rod. Chintu Kumar (petitioner) fired which hit on the leg of the informant. On seeing the the covillagers, all the accused persons fled from the spot. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and the injury has been caused on the non-vital part of the body. There is case

Learned counsel for the State opposes the prayer for bail.

Considering the fact that petitioner has caused fire arm injury to the informant and has got two criminal antecedents, the prayer for pre-arrest bail of the petitioner is rejected.
