JUSTICE ALOK KUMAR PANDEY ORAL ORDER 14-11-2025 This modification application has been filed for modification of the order dated 19.09.2025, passed by this Court in Cr. Misc. No. 54268 of 2025, wherein, while imposing the condition regarding bailor, it has been ordered that one of the bailors shall be either father or mother or sister or brother or wife or the person who has sworn the affidavit in bail application.
2. Learned counsel for the petitioner has submitted that petitioner has already been granted bail on 19.09.2025, but petitioner has failed to comply the said condition as the mother of the petitioner has died much earlier and petitioner has no sister, brother has refused to submit bail-bond because his wife has allegedly been killed by the petitioner. So far wife of the
Patna High Court CR. MISC. No.76974 of 2025(2) dt.14-11-2025 2/2 petitioner is concerned, she is accused in the present case.
3. In the light of aforesaid circumstances, the petitioner has stated in para-6 that the uncle or the villager and the agnates of the petitioner is ready to become bailor in this case.
4. Learned counsel for the State does not controvert the said submission.
5. Accordingly, the order granting bail stands modified to the extent that one of the bailors shall be uncle or the villager and the agnates of the petitioner.
6. The modification application is allowed.
