Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 355.320 liters foreign liquor has been recovered from the vehicle.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Name of the petitioner transpired during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent of similar nature.

No.6288 of 2023(2) dt.13-04-2023 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise 1st, Begusarai in Barauni (Chakia O.P.) P.S. Case No. 466 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
