JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 Petitioner seeks regular bail in connection with Special (POCSO) Case No. 147 of 2019, arising out of Agamkuan P. S. Case No. 707 of 2019, registered for the offences punishable under Sections 323, 341, 354, 354A, 427, 504, 506, 34 of IPC.

As per F.I.R. son of the petitioner outrage the modesty of the daughter of informant and when he complained about the same, petitioner has assaulted the informant and others. Submission of the learned counsel for the petitioner is that F.I.R. itself disclosed that allegation of outraging modesty is against the son of the petitioner. He is in custody since 03.08.2019. Further submission is that he has no criminal antecedent and he is aged about 60 years. He is ready to abide by any condition imposed upon him.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions JudgeI-cum-Special Judge, POCSO, Patna, in connection with Special (POCSO) Case No. 147 of 2019, arising out of Agamkuan P. S. Case No. 707 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in the trial.
