Earlier, the bail petition of petitioner was rejected, vide order dated 03.03.2021 passed in Cr.Misc. No. 1142 of 2021.

Learned counsel for the petitioner submits that similarly situated co-accused Pinku Singh @ Raj Kumar Singh has already been granted bail by a coordinate Bench of this Court, vide order dated 31.08.2022 passed in Cr.Misc. No. 20863 of 2022 (Annexure - 3 to the petition). He further submits that in this case, charge has already been framed and petitioner is in custody since 04.06.2020.

Considering the fact that similarly situated co-accused

Patna High Court CR. MISC. No.1275 of 2023(3) dt.15-03-2023 2/2 has already been granted bail by a coordinate Bench of this Court and petitioner is languishing in jail since 04.06.2020, the prayer for bail of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge - XIV, Bhagalpur in connection with Shahkund (Sajaur) P.S. Case No. 108 of 2020 / S.Tr. No. 197 of 2021.
