ANJANA MISHRA ORAL ORDER 24-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.06.2018 in connection with Buxar(I) P.S. Case No.94 of 2018 corresponding to POCSO Case No. 30 of 2018 registered for the offence under Section 376 of the I.P.C. and Section 4 of the POCSO Act. Learned counsel for the petitioner submits that though the petitioner is named in the F.I.R., subsequently the victim girl in her statement under Section 164 Cr.P.C. has categorically denied the prosecution story and has not named the petitioner, rather she specifically stated that the person concerned was not known to her and the boy had merely slapped her and not indulged in any sexual offence.

No.45930 of 2018 (2) dt.24-08-2018 2/2 In view of the aforementioned facts and circumstances and also the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.S.J.-1-cum-Special Judge, SC & ST POCSO Act, Buxar, in connection with Buxar(I) P.S. Case No.94 of 2018, corresponding to POCSO Case No. 30 of 2018.
