Petitioner seeks regular bail in connection with Special Case No.6023 of 2019, arising out of Khajekalan P.S. Case No.287 of 2019, for the offences punishable under Sections 30(a)/38/41 of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The allegation against the petitioner is that police recovered a total quantity of 17.100 litres of illicit liquor from the field of one Ajit Kumar and arrested the petitioner in connection with the same.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of

Patna High Court CR. MISC. No.73834 of 2019(2) dt.11-12-2019 2/2 secret information received by the police that petitioner was indulged in sale of illicit liquor. Learned counsel further submitted that the petitioner has got no criminal antecedent and he is in custody since 11.07.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that illicit liquor has been recovered from the field of one Ajit Kumar and further the petitioner has got no criminal antecedent and he is in custody since 11.07.2019, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No.6023 of 2019, arising out of Khajekalan P.S. Case No.287 of 2019.
